First Things First-When Someone or Something Hurts You
No Matter The What or Why or How of Any Injury Suffered by you or anyone in your family, here are five things you should always do:
1) Make absolute sure that your health and safety are being tended to; this is no time to take chances or to put off seeking proper medical help; this is also no time to be stoic or brave or “ride it out”. You must try to be certain that there are no hidden injuries, no internal injuries, no subtle problems that can, and sadly, often will erupt into a significant injury process. Get to your doctor or local hospital emergency room promptly. (Note to the wise: My chiropractic friends do NOT like my saying this but as liability insurance carriers deeply discount and scoff at their modes and methods of treatment, you SHOULD ALWAYS seek primary care, medical doctor treatment.)
2) As you seek medical treatment, be articulate and persistent in explaining to the attending physicians what your SPECIFIC hurts and problems are. Do not sit back and let them tell you what your problems are UNTIL you have clearly and concisely and thoroughly told them what is hurting you. If they don’t get it the first time, tell them again and again until they have responded completely to your complaint. Too many injured folks are too passive in their initial medical evaluations and problems are all-too-often left to fester. If you or your loved one are so badly injured as to not be able to speak up, get someone to do it for them. BE ASSERTIVE. Request necessary consultations. Do what is needed. Your intuition and “Sixth Sense” is so very, very often exactly right. Remember, the doctor and hospital is there to care for you. You are the Customer. They are the Employee. Then, TAKE SOME MORE! These should include the scene of injury, the cars and/or items and/or anything else that played a part in the incident. You don’t need expensive equipment to do this; simply purchase inexpensive disposable cameras from convenience stores, WalMart, or Target. Their quality is excellent and reliable. Also, make sure any and all visible injuries and surgeries are photographed and documented throughout the initial injury process through the various stages of healing and recovery.
4) Make sure that you accurately record and document your recollections and memories as to “what happened” AS SOON AS POSSIBLE. WRITE THESE DOWN Or TAPE RECORD THEM Or DICTATE THEM TO A TRUSTED FAMILY MEMBER Or FRIEND. If you have gaps in your memory, work with your family and friends in conversation and discussion to recall what took place. Be active about this. It is Very Important. Ask for and receive copies of all Police Accident Reports or Incident Reports or Investigative Reports and All Accompanying Supplements and Photographs. If you can identify or find witnessed to what happened, make good effort to contact them and get their observations and recollections.
5) If you have ANY SENSE AT ALL that someone or something has wrongfully and negligently hurt you, make plans to contact and go to an experienced personal injury attorney AS SOON as you are able. Time is of the essence. DO NOT FALL PREY to any early contacts, suggestions or promises made by any insurance person from the other side.
