Defective Products
Roebuck vs. Cosmetic Company. Client bought eyelash cosmetic which came with replaceable refills; client instructed by company's 'sell direct' sales representative to keep brush and discard empty container. Client did as instructed. "Old" brush became infected with pseudomonous bacteria; client's eye became infected., then blind in eye; total loss of site. Case settled for $350,000 before trial.
Rergner vs. Advance Lamp Company. Client worked in beauty shop which had flexible 'goose necked' drying lamps. While drying customer's hair, she adjusted lamp's light and in doing so, lamp's neck cover failed after repeated bendings, causing jagged metal covering to 'bite' into and beyond insulation covering lamp's internal wiring. Client receives terrible electrical shock and is unconscious when sweeping employee knocks lamp from her hand with wooden broom. Burns and nurologic injuries including migraine headaches, extremeity pain and numbness and scarring to hands. Case settled before trial for $325,000.
Bascomb vs. Sears. Lady was in store looking to purchase a microwave over.While looking over merchandise, store employee was moving high shelf ladder steps next to her. Steps struck improperly shelved air conditioner two levels above client. Air conditioner fell, smashing into client's arm and wrist. Client suffered permanent, continuous, burning severe pain injury, diagnosed ar Reflex Sympathetic Distrophy (RSD). Case settled for $400,000.
